Dani Alves’ court appeal rejected again after he appealed for a bail in relation to the sexual assault accusations made against him

The judge in the rape case has again rejected former player Dani Alves’ request for release from prison. Since January 20, 2023, Alves has been imprisoned in Brians 2 after a young woman accused him of raping her at the Barcelona nightclub Sutton. The defence claimed that Alves and the lady had consensual intercourse, but the court found that “there is more than enough evidence” to prove that Alves had sexually assaulted the woman that evening.

Alves had earlier requested release on February 21, 2023, but the judge had rejected that request as well. A second appeal can be made to the Barcelona Court of Appeal by his attorney Cristobal Martell, but given this most recent ruling, it appears doubtful that Alves will be freed very soon.

The defence claimed that Alves did not constitute a flight risk since he had social, economic, and personal ties to Barcelona, but the judge dismissed this claim owing to the danger of flight that Alves’ riches presented. The absence of an extradition pact with Brazil, where Alves is from, also played a significant role in the judge’s judgement.

Despite these obstacles, the Barcelona Court of Appeal authorised a psychologist chosen by Alves’ defence to interview the young lady who had lodged the complaint. It is a good development for the defence that this ruling may have an effect on the case.

It’s vital to understand that Alves’ request for release has already been denied. The court has continuously concluded that there is enough evidence to substantiate the charges of rape against Alves despite the defense’s repeated claims that the sexual interactions were consensual.
