The discrepancies between Alex Baena’s story and the video recorded by cameras at Estadio Santiago Bernabéu severely undermined the case against Fede Valverde. As a result, the Madrid 48th Instruction Court rejected the lawsuit, and the Comité de Competición has now upheld this judgment.
The Competición decision comes after the judicial procedures were provisionally dismissed and ended because there was not enough evidence to support the supposed minor crime that sparked the case. They therefore see any decision other than acquittal as being unjustified.
“The above conclusion determines that it is not necessary to consider the various issues raised in the indictment and in the arguments submitted, without prejudice to this Committee valuing and appreciating the solid and motivated work carried out by the Investigating Officer,” stated the Competición’s resolution.
The resolution also adds, “It is therefore appropriate to declare the dismissal and closure of this file, without prejudice to the provisional nature of such closure, in the event that the criminal proceedings were resumed, in any case, and a different conclusion on the events occurred was reached. The file may be reopened, provided that the relevant infraction has not prescribed.”
Competición informs everyone that they have ten business days beginning on Wednesday, July 26, to file an appeal against this judgment with the Comité de Apelación.
